THE COMPETENCIES OF THE PRESIDENT OF THE RDTL TO INAGURATE THE MINISTERS FOR STATE INSTITUTION BASED ON THE CONSTITUTION

ABSTRACT
The authority of the President of RDTL to appoint the prime minister for the seventh constitutional government does not reflect on the characteristics of the parliament in accordance with the Article 85 paragraph (d) and Article 106 paragraph (1), Constitution of RDTL, will become the primary issues discuss in this paper. The normative juridical research statute and conceptual approach are utilized for further discussion in this paper. Thus the authority of President of RDTL is "constitutional authority "bound" in nature. Based on the constitution, when the president is to appoint or and swear in a prime minister, he or she must fulfilled all the constitutional requirements, based on the characteristics of the system of parliamentary government based on the two articles above.
